I'm Andrew Mishlove, and this is my video series "How to Win a Drunk Driving Case: A Guide for the Layperson, Seven Key Factors in Drunk Driving Defense."
This section is about the second factor, which is your theme, or the story of your day.
Now the first factor, as I told you, was you: what kind of person are you, what is your image.
This factor, the second factor, focuses on how you got into this mess: what happened to you that day, why were you in that place, where were you coming from, where you were going to.
So, for example, I had a client who was arrested on the way home from the memorial service for his late wife, obviously a critical factor. Other people have been arrested because they were trying to help somebody who was injured and get them to the hospital. I once had a young lady who was fleeing from a man who was abusing her.
All these things, the way that your day progressed and how it led to the situation where you found yourself in trouble, these are things that we need to really evaluate in order to develop a theme for you, a story of your day, and why the accusations are just not fair. That's the second critical factor in drunk driving defense.
